These general conditions of sale apply to the purchase of products (hereinafter ‘Products’) from the website www.archema.it (hereinafter the ‘Website’) made through the Website itself by users qualifying as ‘Consumers’. The Website, owned by Archema S.r.l. with registered office in Settimo Milanese (MI), Via Stelvio 19, tax code/VAT number 09859960156, is managed by the same company, Archema.
The parties to the purchases of Products made through the Website are Archema S.r.l. as the seller (hereinafter the ‘Seller’) and the person who purchases one or more Products, other than for business, commercial, craft or professional purposes, as the purchaser (hereinafter the ‘Consumer’), (Seller and Consumer will be hereafter referred to as the ‘Parties’). Any communication by the Consumer connected and/or related to the purchase of the Products - including any reports, complaints, requests concerning the purchase and/or delivery of the Products, the exercise of the right of cancellation, etc. - must be sent to the Seller’s email address at email@example.com
The Website is dedicated to retail. Persons who are not Consumers are advised not to execute purchase orders. Should one or more sales be made to a non-qualifying Consumer, the following general conditions of sale shall apply, notwithstanding the provisions of the same:
a) the purchaser shall not be granted the right of cancellation;
b) the purchaser shall not be granted any other protections, here provided in favour of the Consumer, that reflect or comply with mandatory provisions of law;
c) the contract of sale between the Seller and the Consumer shall be governed by Italian law, with the exception of the United Nations Convention on Contracts for the International Sale of Goods - 1980 Vienna Convention.
To make purchases through the Website, the Consumer must be at least 18 years old and have legal capacity to act, which the Consumer declares to possess.
The Products presented on the Website may be purchased by selecting the Products of interest to the Consumer and placing them in the appropriate virtual shopping cart.
Protection of privacy
The Consumer declares and guarantees that the data provided to the Seller during the registration and purchase process are correct and true.
The Consumer may at any time update and/or modify their personal data provided to the Seller through the ‘My Account’ section of the Website accessible upon authentication.
Although the Seller takes measures to protect personal data against any loss, falsification, manipulation and misuse by third parties, due to the characteristics and technical limitations relating to the protection of electronic communications via the Internet, the Seller cannot guarantee that the information or data provided by the Consumer on the Website, even after the Consumer has provided authentication (logged in), are not accessible or viewable by unauthorised third parties.
